On June 23, 2020, the DOL published a proposed rule clarifying that ERISA’s duty of loyalty prevents ERISA plan fiduciaries from investing in ESG vehicles when the plan fiduciaries understand an underlying investment strategy of the vehicle is to subordinate return or increase risk for the purpose of non-pecuniary objectives. This proposal intends to clarify confusion created by previous sub-regulatory guidance applicable to ESG vehicles and provide certainty in this area.
