The ERIC Legal Center advocates for large employers on legal matters affecting their ability to provide health, retirement, paid leave, and other compensation benefits to their nationwide workforces. The Center engages in litigation to preserve ERISA preemption, fights against state mandates and other measures that threaten ERISA preemption, and intervenes in matters that have the potential to significantly affect the design and administration of employee benefit plans under ERISA.

Benefits rules are often determined in federal or state courts, rather than by Congress, federal agencies, or state legislatures. And a strong voice that exclusively represents large employer plan sponsors can make – and has made — the difference. ERIC’s involvement in litigation is to support our member companies and preserve their ability to design and administer benefits uniformly, without compliance burdens, mandates, or taxes, and with strong federal ERISA preemption protection.
