The deadline is quickly approaching for the 12-member Super Committee to approve up to $1.5 trillion in deficit reduction, but to this point, the two parties still appear to be far apart in reaching an agreement. ERIC continues to express strong opposition to including the proposal to increase PBGC premiums and provide authority to the PBGC Board to increase variable-rate premiums based on “publicly available measures of risk or exposure.”

ERIC also filed extensive comments on various proposed regulations to the Patient Protection and Affordable Care Act, including on the uniform summary of benefits and coverage provisions, on how the exchanges will interact with employers, and on the proposed safe harbor for determining the affordability of employer-sponsored coverage for purposes of the shared-responsibility provisions.

Meanwhile, the regulators were busy last month releasing an array of guidance, including a DOL final rule on investment advice, an IRS notice extending some hybrid plan deadlines, and the SEC’s release of a “no-action letter” on 401(k) plan fee disclosure rules.
