11/13/18 - 401(k) Fee Litigation – Could Settlement Amounts be Deemed Plan Funds?

ERIC has discussed with the Department of Labor and Key Congressional Staff the concept of deeming settlement amounts from 401(k) fee litigation as plan funds and not general assets. As such, the settlement amounts would be directed towards plan participants and beneficiaries and only reasonable fees to the plaintiff attorneys. The webinar will be led by Richard Shea and Michael Francese, both from Covington & Burling, who will develop a letter to the DOL that will focus on the legal reasoning behind why the DOL has the authority to issues this type of guidance.
