The Department of Labor (DOL) has increased the number of audits in the area of missing participants in both 401(k) and pension plans. The purpose of this call is to review the actions of the DOL, discuss reasons for the focus on missing participants, and learn about fiduciary concerns and best practices.

Tess Gee, Miller & Chevalier, will lead the call. Tess counsels clients on fiduciary investigations, such as missing participant audits, and other DOL enforcement initiatives and priorities, and defends clients in ERISA litigation. She spent close to 15 years with DOL representing the government in ERISA matters, most recently as Deputy Associate Solicitor, prior to joining Miller & Chevalier.
