We have scheduled a FocusOn call to discuss Treasury Notice 2015-40, which bans lump sum windows for retirees/beneficiaries in pay status as of July 9, 2015. Robert Newman and Mike Francese of Covington will provide legal and procedural analysis on this issue, including the background of lump sum windows for individuals in pay status, the reaction from some policymakers and advocacy groups, as well as the details of Notice 2015-49, including Treasury Department analysis of section 401(a)(9) and reasoning behind the ban on the lump sum windows in this context. We also will kick off a discussion regarding ERIC’s strategy in reaction to Notice 2015-49, including whether we should raise a concern over process and formally request a withdrawal of Notice 2015-49 until formal notice and comment has taken place through proposed rulemaking.
