ERIC’s Legal Committee and the law firm of Miller & Chevalier invite you to participate on a FocusOn Conference Call to discuss recent developments in the ERISA claims area.

Participating on the call will be Anthony Shelley of the law firm Miller & Chevalier. Mr. Shelley is a Member and Chair of the firm’s Executive Committee. Mr. Shelley's practice focuses on the litigation of pension benefit and health care issues before the federal and state trial and appellate courts and administrative agencies. His experience includes the litigation of matters involving ERISA and other federal employee benefits statutes before the U.S. Supreme Court and numerous federal courts of appeals.

The session will cover important recent court cases and related legal developments:

• The oral argument that recently occurred in the Supreme Court in Heimeshoff v. Hartford Life. We'll explore which way the Court might be leaning on the question of when a benefits claim accrues for purposes of measuring the statute of limitations, and the possible impact on plan language and litigation.

• The rapidly developing case law in the Circuits in the wake of CIGNA v. Amara (Supreme Court case now back before the Second Circuit) on when, or if, the remedy of surcharge (and monetary relief generally) is now available in ERISA cases. ERIC recently filed an amicus brief in the Foot Locker case currently before the Second Circuit (after the district court dismissed the case) regarding equitable remedies issues.

• The enforceability of a forum selection clause for litigation, when the clause is contained in an ERISA plan.
