Congress returns this week to resume its lame-duck session and the final push of the 113th Congress before adjourning. There are a few must-do items, including addressing government funding for the current fiscal year (which began October 1) beyond a temporary measure that expires on December 11, and possibly extending or making permanent some or all of the expired tax provisions. At this point, however, disagreements persist between and within the two parties.
ERIC recently submitted comment letters on the Department of Labor’s request for information on the use of brokerage windows within participant-directed plans, and on the Pension Benefit Guaranty Corporation’s Information Collection Request on payouts to certain former employees.
Over the past couple of weeks, the agencies overseeing implementation of the Affordable Care Act have issued a string of guidance addressing, among other things, the Transitional Risk Reinsurance Programs, the market reform provisions, minimum value standards, and stop-loss insurance.
Meanwhile, members of the Senate Health, Education, Labor and Pensions Committee recently pressed two nominees for the Equal Employment Opportunity Commission over the commission’s recent action going after company wellness programs before publishing updated guidance.
