As Congress heads in to the home stretch before heading out in August for a month-long summer recess, House and Senate lawmakers are looking to offset a highway transportation funding bill with an extension of pension smoothing relief enacted under MAP-21. The House and Senate bills as currently drafted do not include increases in PBGC premiums.

Speculation now starts on who the Obama Administration will nominate to replace outgoing PBGC Director Josh Gotbaum, who announced on Friday that he will be resigning after four years with the agency.

The U.S. Supreme Court completed its current term by issuing key decisions finding that the “presumption of prudence” does not apply at the pleading stage in stock drop cases, and that the contraceptive coverage requirement of the Affordable Care Act violates the Religious Freedom Restoration Act with respect to closely-held corporations.

Meanwhile, ERIC over the last several weeks has held a series of conference calls and discussions involving our recently established tax forces addressing the future of COBRA and implementation of the ACA Cadillac tax in 2018.
