Congress returns next week from its summer recess facing a busy agenda in the fall as lawmakers prepare for a final push of campaigning for the mid-term elections.

Prior to recessing, Congress approved and President Obama signed into law a highway funding bill that included an extension of the pension smoothing provisions enacted under MAP-21. Representative Pat Tiberi (R-OH) recently introduced legislation to provide relief from ongoing nondiscrimination testing for frozen defined benefit plans, while the Department of Labor requested information on the use of brokerage windows in 401(k) plans.

The IRS finally released draft instructions that are designed to be a matched set with the drafts of the forms that will be used to report health plan coverage information to employees and to the government pursuant to the Affordable Care Act (ACA) rules under sections 6055 and 6056 of the Internal Revenue Code.

Meanwhile, the EEOC jumped into the wellness fray recently by filing a complaint against Orion Energy Systems, alleging that the company violated the Americans with Disabilities Act because it forced an employee to submit to medical exams and inquiries that were not job-related and consistent with business necessity as part of a voluntary wellness program.
