Litigation continues to be the bane of plan sponsors’ existence. Federal court dockets throughout the country include significant ERISA and benefit cases. There is no apparent way to assure avoidance of litigation. However, we can learn from the experience of others (and sometimes our own companies) as they have faced off with an aggressive litigation bar.
That’s why we are focusing on often contentious matters such as fiduciary claims, communication issues, procedural matters and subrogation in the upcoming issue of the Benefits Litigation Update to be issued in very early September. Occasionally, litigation not related to employee benefits has a dramatic impact on plan design and administration. The DOMA Supreme Court decision is one of those cases and the fallout from that will be addressed in the latest Litigation Update.
