The drama over whether the federal government will shut down due to disagreements over the funding legislation for the new fiscal year appears to be consuming all of Washington. The House and Senate continue to play a game of ping pong in sending amended versions of a continuing resolution back and forth in hopes that one side will eventually give in. The fate of all or part of the Affordable Care Act could be tied to the outcome of this battle.

Meanwhile, the Labor and Treasury departments recently released additional guidance concerning the treatment of same-sex spouses following the U.S. Supreme Court’s decision in United States v. Windsor. ERIC also submitted comment letters addressing the DOL’s recent Field Assistance Bulletin on participant fee disclosures, and the PBGC’s proposed regulations regarding the rules for premiums and penalties.
