As we head into the home stretch of the campaign season, major changes could be on the horizon. Lawmakers will need to address the so-called fiscal cliff set to occur at the end of this year. In addition, the election results will have major ramifications no matter who wins the presidency and which party controls the House and Senate. Both parties agree that tax reform and deficit reduction need to be addressed, and these efforts could have a significant impact on employee benefit plans.

Meanwhile, while Congress has been on its summer recess, ERIC has been busy on the regulatory side. ERIC recently met with Treasury officials regarding our concerns over proposed hybrid plan regulations. There also is a developing concern regarding possible Treasury MAP-21 impending funding guidance relating to the valuation for funding purposes of lump sums under non-hybrid plans.

Focus also continues on urging regulators to issue urgently-needed guidance and address various ambiguities in the Affordable Care Act. Just this week we wrote to the Obama Administration urging the White House to clarify and support the interpretation that employers are not required to offer dependent coverage in order to meet their shared responsibility obligations under the ACA.
