Court of Appeals Strikes Down Maryland "Fair Share" Statute



The New York Times reports this afternoon that the Fourth Circuit Court of Appeals struck down a Maryland statute, which primarily affected Wal-Mart, that requires a threshold of employer spending on health care coverage for employees. In a 2-1 decision the court held that the Maryland law violates ERISA.
