ERIC Files Amicus Brief in IBM Case

ERIC filed a joint amicus brief November 4 with the U.S. Court of Appeals for the Seventh Circuit in response to the decision in Cooper v. IBM.

In that decision, the U.S. District Court for the Southern District of Illinois ruled that IBM’s cash balance pension plan, commonly known as a ‘hybrid’ plan, is inherently age discriminatory and therefore unlawful. IBM appealed the ruling and on October 28, filed its brief with the court.
