ERIC Urges OMB Approval of EEOC Regulation

Nov. 16, 2004 -- In a meeting and follow-up letter today with Office and Management (OMB) Director for Human Resource Programs Dean Clancy ERIC staff urged that OMB approve the EEOC's regulation exempting from the Age Discrimination in Employment Act (ADEA) permitting employers to coordinate post-employment health care coverage with Medicare.

The EEOC proposed rule is in the final approval stages after being delayed until after the November elections. ERIC and other business and labor groups met last week with CMS staff together with representatives of AARP. AARP argued that employers should be required to continue providing retiree health benefits regardless of Medicare eligibility. ERIC and others argued against the AARP position.

ERIC members and other employers are urged to write their own letters to the OMB (see ERIC letter attached). Letters should be directed to:
