ERIC July 26 FocusOn Call: Legal Risk Management Considerations in Plan Investments -- What Plan Sponsors Need to Know
ERIC and the law firm of Winston & Strawn will review "Legal Risk Management Considerations in Plan Investments -- What Plan Sponsors Need to Know" for both in-house counsel and other benefits professionals with responsibility for plan investment matters.
The call will be held on Tuesday, July 26, 2011, at 2:00 PM (EDT).
What's it all about: As plan fiduciaries consider the risk of participant lawsuits, and as regulators continue to push for more transparency and disclosure of plan investment matters, Marla Kreindler and Julie Stapel, partners in Winston & Strawn's Employee Benefits and Executive Compensation practice, will help plan sponsors make sense of how fiduciary governance structures and the terms of plan investment agreements can both help plans obtain high quality investment products and services, as well as avoid the growing threat of fiduciary liability.
The presentation will:
- Review fiduciary governance basics as a foundation for the discussion of plan investment structures and agreements.
- Compare and contrast different types of plan investment structures.
- Identify and discuss key legal terms in plan investment-related agreements, including the allocation of fiduciary responsibility, representations and warranties to be obtained from investment service providers, valuation, reporting and disclosure, transparency and indemnification, among others.
- Identify how plan sponsors can manage legal risk in implementing plan investments, including coordination with investment policies, documentation, and negotiation of contract terms.
