Following up on our previous webinar, we will discuss the results of the Pension Overpayment survey and how those results will shape ERIC’s policy position on the issue of pension overpayments and recoupment. As we previously discussed, the Hill has taken interest in this topic with proposed legislation stating that it will not be a breach of fiduciary duty if a plan sponsor decides not to attempt recoupment of an overpayment. However, this legislation raises the issue of whether there are instances when the plan sponsor should still attempt recoupment or is even allowed to attempt recoupment. In addition, other groups have begun shaping proposals which will be reviewed on the call. Therefore, this webinar is an opportunity to shape ERIC’s policy proposal on pension overpayments and recoupment.
