8/23/19 Biweekly State Paid Leave Strategy Call

This week’s strategy call will focus on the expansive legal definition of “family member” recently adopted by legislation in Oregon, Connecticut, and New Jersey, and which has been included in many other state bills proposing paid family and medical leave programs.

This new definition, which includes the catch-all phrase “any individual related by blood or affinity whose close association with a covered individual is the equivalent of a family relationship” is particularly open ended and leaves a lot of room for regulatory interpretation. Paid family and medical leave will continue to be an incredibly popular topic at the state level in 2020 legislative sessions, and it is important that employers help shape the practical application of this definition to prevent abuse of important paid family and medical leave benefits by employees.

On our call, we will discuss the legal meaning of “affinity” as well as develop strategies to best guide regulators away from an overly expansive interpretation of this new definition.
