John Ferreira and his colleague Christopher Weals, Morgan Lewis, will lead a 75 minute discussion on recent legal cases affecting plan sponsors, and the health and retirement plans they provide to workers and families across the country.
Topics will include:
• Fifth and Tenth Circuit decisions on the fiduciary rule and DOL's response;
• Supreme Court’s summary reversal in CNH v. Reese and remand in UAW v. Kelsey-Hayes and Sixth Circuit decision in Cooper v. Honeywell;
• The standard of review for benefit claims where a plan administrator misses deadlines (conflicting decisions in Reliance Standard and Aetna);
• Fiduciary status when negotiating fees (Transamerica and Voya cases); and
• Sequoia Fund litigation.
