07/29/15 - Benefits Litigation Update Call

Wednesday, July 29, 2015 (2pm - 3:30pm US/Eastern)

Call Time: 2:00 p.m. - 3:30 p.m. (ET)

This is a member-only call.

Please join the lawyers of Epstein Becker Green and ERIC staff for an in-depth review of the latest benefits litigation news.

Here are just a few of the key cases we will cover during this call:

1) A discussion of whether an employer’s workforce management strategy violated worker rights under the Affordable Care Act and ERISA by allegedly keeping employee hours under 30 hours per week to avoid having to give them health benefits (Marin v. Dave & Buster’s, Inc.);

2) The continuing duty of a fiduciary to monitor investments in a 401(k) plan (Tibble v. Edison International); and

3) Whether a plan can recover overpayments made to a participant in a health plan by another party (Board of Trustees of Nat’l Elevator Indus. Health Benefit Plan v. Montanile).

We will, of course, also delve briefly into the recent U.S. Supreme Court decisions in King v. Burwell (on the issue of whether participants in federally-run Exchanges are eligible for tax subsidies) and Obergefell v. Hodges (on whether states must recognize same-sex marriage). We will also discuss the most recent significant telehealth issues.

And best of all: the discussions will be short, sweet, and --- drum roll --- short of abstruse legal terminology. Completely accessible and enjoyable even to the non-lawyers among us!
